はじめに
Murphy's Workshop はプライバシーを尊重し、個人データの保護に努めています。本通知では、アクセス元を問わず当サイト訪問時の個人データの取扱い、プライバシー上の権利、法的保護について説明します。
本通知は階層形式で、以下の各項目へ移動できます。用語の意味については用語集もご覧ください。
本サイトは子ども向けではなく、子どもに関するデータを故意に収集しません。未成年の方は、当社へコンテンツや情報を送信する前に、保護者または法定代理人へ相談してください。
1. ウェブサイト運営者
このウェブサイト（murphy-workshop.com）は Murphy's Workshop が運営しています。
データ管理者
Murphy's Workshop（代表 Luca Deguin）は、本サイトで収集する個人データの管理者です。ただし、Tebex が処理する決済データを除きます。

監督機関
データ保護に関するフランスの監督機関 CNIL（Commission Nationale de l'Informatique et des Libertés）へ、いつでも苦情を申し立てる権利があります（www.cnil.fr）。ただし、CNIL へ連絡する前に当社が懸念へ対応する機会を いただけますと幸いです。まずは当社へご連絡ください。
2. ホスティング事業者
このウェブサイトは OVH SAS がホストしています。
データの保存場所
データは欧州連合内（フランス）のサーバーに保存されます。OVH は GDPR に準拠し、データを守る適切なセキュリティ対策を講じています。
3. 認証サービス（Webba ID）
本サイトのユーザー認証には、Webba Creative Technologies が提供する Webba ID を使用しています。
Webba ID の仕組み
Murphy's Workshop へのログインには Webba ID を使用し、Discord、Google など対応する OAuth プロバイダーで認証できます。
Webba ID 経由で収集するデータ
認証時、Webba ID は選択した OAuth プロバイダーから次の情報を収集します。
- Email address
- First name
- Last name
- Avatar (profile picture)
このデータは選択した OAuth プロバイダー（Discord、Google など）から提供され、Murphy's Workshop のアカウント作成と管理に使用されます。
データ処理
Webba Creative Technologies は認証データの処理者として機能します。収集データは次の目的にのみ使用されます。
- Creating and managing your user account
- Identifying you when you log in
- Displaying your profile information on the website
- Communicating with you regarding your account and purchases
お客様の同意
Webba ID でログインすると、選択した OAuth プロバイダーから上記データを収集することに同意したものとみなされます。アカウント削除を当社へ依頼することで、いつでも同意を撤回できます。
4. 決済事業者（Tebex）
Tebex について
このサイトでの支払いはすべて Tebex Limited が処理します。購入時、決済処理についてお客様と Tebex の間に直接の関係が成立します。

5. 当社が収集するデータ
個人データまたは個人情報とは、個人を識別できるあらゆる情報を指します。個人を特定できない匿名データは含まれません。
当社が収集、利用、保存、移転する個人データは、次の区分 に分類されます。
- Identity Data includes first name, last name, username, and avatar/profile picture (collected via Webba ID from your OAuth provider).
- Contact Data includes email address (collected via Webba ID from your OAuth provider), and for purchases: billing address and telephone numbers (collected by Tebex).
- Transaction Data includes details about payments to and from you and other details of products and services you have purchased (processed by Tebex).
- Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
- Profile Data includes your username, avatar, purchases or orders made by you, and any account preferences.
- Usage Data includes information about how you use our website, products and services.
- Marketing and Communications Data includes your preferences in receiving marketing from us and your communication preferences.
統計・人口統計データなどの集計データも、目的を問わず収集、利用、共有します。集計データは個人データから生成される場合がありますが、直接または間接的に個人を特定しないため、法律上の個人データには該当しません。
人種・民族、宗教・思想、性生活・性的指向、政治的意見、労働組合への加入、健康、遺伝・生体情報など特別な種類の個人データ、および犯罪歴や違反情報は収集しません。
個人データをご提供いただけない場合
法律またはお客様との契約に基づき個人データが必要なときにご提供いただけない場合、契約を履行または締結できないことがあります。その場合は商品・サービスを取り消すことがありますが、該当時にお知らせします。
6. 個人データの収集方法
当社は、次を含むさまざまな方法でお客様に関するデータを収集します。
Webba ID 認証
アカウント作成またはログイン時、Webba ID が選択した OAuth プロバイダー（Discord、Google など）から氏名、メール、アバターを取得します。認証時にこの転送を許可します。
直接のやり取り
フォーム入力や当社との連絡を通じて追加データを提供できます。これには次の場合に提供する個人データが含まれます。
- Create an account on our website (via Webba ID)
- Make a purchase through our webstore (processed by Tebex)
- Open a support ticket via Discord

自動収集技術

7. 個人データの利用方法
個人データは法律で 認められる場合にのみ使用し、主に次の状況で利用します。
- Where we need to perform the contract we are about to enter into or have entered into with you.
- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
- Where we need to comply with a legal or regulatory obligation.
第三者によるメールでの直接マーケティングを除き、通常は同意を個人データ処理の法的根拠にしません。マーケティングへの同意はいつでも撤回できます。

Marketing
marketing や広告を中心に、個人データの利用について選択肢を提供するよう努めています。アカウント内の設定センターで、個人データ利用に関する内容を確認・選択できます。
当社へ情報を請求した、または商品・サービスを購入したお客様には、marketing 配信を停止していない場合に限り、当社からご案内をお送りします。
配信停止
サイトにログインして該当項目を切り替え、marketing 設定を変更するか、配信メッセージの停止リンクを使用するか、当社へ連絡することで、いつでも当社または第三者からの marketing 配信を停止できます。
Cookies
browser の設定で Cookies の一部またはすべてを拒否したり、サイトが Cookies を設定・利用する際に通知したりできます。無効化または拒否すると、サイトの一部へアクセスできない、または正常に動作しない場合があります。
8. 個人データの開示
上記第4項の表に記載した目的のため、以下の関係者と個人データを共有する場合があります。

- Specific third parties such as our Webstore partners and Amazon Web Services.
- Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets.
すべての第三者に個人データの安全と法令に沿った取扱いを義務付けます。サービス提供者が独自目的で使うことは認めず、指定目的に限り当社の指示で処理します。
9. 国際移転
外部第三者の多くは欧州経済領域（EEA）外に所在するため、個人データの処理に伴い EEA 外へデータが移転されます。
EEA 外へ個人データを移転する際は、次の保護措置のうち少なくとも一つを講じ、同等の保護を確保します。
- We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
- Where we transfer Personal Data from the EEA to a recipient outside the EEA that is not in an Adequate Jurisdiction, we may use specific contracts (Standard Contractual Clauses) approved by the European Commission which give personal data the same protection it has in Europe.

10. データセキュリティ
個人データの紛失、不正利用・アクセス、改変、開示を防ぐため、適切なセキュリティ対策を講じています。また、業務上知る必要のある従業員、代理人、請負業者、第三者にのみアクセスを制限しています。これらの者は当社の指示に従って処理し、守秘義務を負います。
次のセキュリティ対策を守ることで、個人データの保護にご協力いただけます。
- Do not confirm your bank or credit card details in an email. We will not ask for such personal data in this way, so any email claiming to be from us that does so is likely to be a fake. Please ignore it.
- Keep your passwords private.
- When creating a password, do not use words such as your name, date of birth or other personal data.
- Change your password regularly.
個人データ侵害の疑いへ対応する手順を整備し、法律上必要な場合はお客様と関係監督機関へ通知します。
11. データ保持
個人データはいつまで利用されますか？
個人データは、法的、会計、報告上の要件を含め、収集目的の達成に必要な期間のみ保存します。
個人データの適切な保存期間は、データの量、性質、機密性、不正利用・開示による被害の可能性、処理目的と代替手段、適用法令を考慮して決定します。
法律により、税務上の目的で、取引終了後最長10年間、お客様の基本情報（連絡先、本人確認、財務、取引データを含む）を保存する必要があります。
状況によりデータの削除を請求できます。詳しくは下記の「 消去の請求」をご覧ください。
状況により、研究または統計目的で個人データを匿名化する場合があります。匿名化後の情報はお客様と関連付けられないため、追加通知なく無期限に利用できます。
12. お客様の法的権利
一定の状況では、個人データについてデータ保護法上の権利があります。
- Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
- Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected.
- Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it.
- Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing.
- Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in certain scenarios.
- Request the transfer of your personal data to you or to a third party in a structured, commonly used, machine-readable format.
- Withdraw consent at any time where we are relying on consent to process your personal data.
上記の権利を行使する場合は、当社へご連絡ください。
通常は手数料不要
個人データへのアクセスなどの権利行使に通常手数料はかかりません。ただし、請求が明らかに根拠を欠く、反復的、過度である場合、合理的な手数料を請求するか、対応をお断りすることがあります。
お客様にお願いする情報
本人確認と個人データへのアクセス権などを確保するため、特定の情報を求める場合があります。これは、受領権限のない者への個人データ開示を防ぐための安全対策です。回答を早めるため、請求に関する追加情報をお願いする場合もあります。
回答期限
正当な請求には 1 か月以内の回答を目指します。複雑または多数の請求では時間を要する場合があり、その際は通知して進捗をお知らせします。
13. 用語集
法的根拠
正当な利益 最高かつ安全なサービス・商品・体験を提供するために事業を運営、管理する当社の利益を意味します。正当な利益に基づく処理の前に、お客様と権利への影響を検討し均衡させます。
契約の履行 お客様が当事者となる契約の履行、または契約締結前にお客様の依頼で手続きを行うために必要なデータ処理を意味します。
法的または規制上の義務を遵守するため 当社が負う法的または規制上の義務を遵守するために必要な個人データ処理を意味します。
第三者
グループ内の第三者： Tebex グループ内で共同管理者として IT・システム管理や経営報告を担うその他の企業。
外部の第三者：
- Service providers acting as processors based within and outside the EEA who provide IT and system administration services.
- Suppliers used by us in connection with the supply and delivery of goods and services to you.
- Professional advisers acting as processors including lawyers, bankers, auditors and insurers based within the EEA who provide consultancy, banking, legal, insurance and accounting services.
- HM Revenue & Customs, regulators and other authorities acting as processors based in the United Kingdom who require reporting of processing activities in certain circumstances.
